These Terms & Conditions apply to the website www.ticketkosta.com, its mobile and desktop versions, related subdomains, checkout pages, customer support channels, and any services operated under the TicketKosta name.

Please read these Terms carefully before using the Website or placing an order. By accessing the Website, creating an account, listing tickets, purchasing tickets, contacting TicketKosta, or otherwise using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Website or place an order.

1. Important marketplace notice

TicketKosta is an independent secondary ticket marketplace. TicketKosta provides an online platform and related services that allow users to buy and sell tickets for live events.

TicketKosta is not the official box office, venue, event organiser, promoter, team, club, federation, artist, tournament owner, or official ticketing partner for any event unless this is expressly stated in writing on the relevant event page.

TicketKosta does not claim any official affiliation, sponsorship, endorsement, authorisation, allocation, or partnership with any event organiser, venue, performer, team, club, federation, tournament, league, or rights holder unless expressly stated.

Tickets listed on TicketKosta are resale tickets. Prices may be higher or lower than the original face value printed on the ticket or charged by the original seller. The price is set according to availability, demand, seller requirements, ticket category, delivery method, and market conditions.

By using TicketKosta, you understand and accept that you are using a secondary marketplace and not an official primary ticket sales channel.

3. Definitions

In these Terms:

“Buyer” means a user who places an order for tickets through the Website.

“Seller” means a user, supplier, broker, professional seller, private individual, or other third party who lists, supplies, transfers, or sells tickets through or in connection with the Website.

“TicketKosta”, “we”, “us”, or “our” means the operator of the Website and related TicketKosta services.

“Website” means www.ticketkosta.com and all related TicketKosta pages, checkout pages, subdomains, customer portals, and online services.

“Ticket” means any ticket, e-ticket, mobile ticket, paper ticket, access code, membership card, pass, voucher, account transfer, app transfer, QR code, barcode, collection instruction, or other right of entry to an event.

“Event” means any sporting event, concert, theatre show, festival, tournament, match, race, performance, competition, or other live event listed on the Website.

“Order” means a request submitted by a Buyer to purchase Tickets through the Website.

“Listing” means any offer, advertisement, description, price, category, ticket information, or availability information displayed on or through the Website.

“Face Value” means the price printed on the Ticket or charged by the original issuer, where known and applicable.

“Platform Services” means the marketplace, checkout, customer support, delivery coordination, seller verification, payment handling, and related services provided by TicketKosta.

“TicketKosta Guarantee” means the limited protection described in these Terms.

4. Scope of these Terms

These Terms apply to Buyers, Sellers, visitors, registered users, and anyone who uses the Website.

Additional terms may apply to certain payment methods, corporate services, promotional offers, membership card deliveries, event-specific rules, country-specific rules, seller agreements, buyer guarantee terms, privacy terms, cookie terms, and fraud prevention processes.

If there is a conflict between these Terms and specific written terms shown during checkout for a particular order, the checkout terms will apply to that order to the extent of the conflict.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited under applicable consumer protection law.

5. TicketKosta’s role

TicketKosta operates primarily as an independent secondary marketplace and intermediary. TicketKosta facilitates transactions between Sellers and Buyers and provides related Platform Services.

Unless TicketKosta is expressly identified as the seller of record for a specific transaction, the contract for the sale of the Ticket is between the Buyer and the Seller. TicketKosta is not the event organiser and does not control the event, venue, entry rules, performer, team, tournament, schedule, seating plan, or admission decisions.

TicketKosta may provide customer support, process payments, coordinate delivery, hold or release seller funds, verify information, manage disputes, replace tickets, or offer remedies under the TicketKosta Guarantee. These actions do not make TicketKosta the official organiser, primary seller, authorised ticketing partner, or rights holder.

Where TicketKosta is expressly identified as the seller of record for a specific transaction, TicketKosta’s obligations are limited to those stated in these Terms and the applicable order confirmation, subject to applicable law.

6. Eligibility and account use

You must be at least 18 years old to create an account, list tickets, or place an order. If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian.

You agree to provide accurate, complete, and current information when using the Website. You must not use false names, false payment information, false addresses, false identity documents, misleading contact details, or third-party payment instruments without authorisation.

You are responsible for keeping your account credentials secure. You must notify TicketKosta immediately if you suspect unauthorised access to your account or misuse of your payment information.

TicketKosta may refuse, suspend, restrict, or terminate access to the Website if we reasonably believe that a user has breached these Terms, provided false information, engaged in fraud, abused the marketplace, violated applicable law, or created risk for Buyers, Sellers, TicketKosta, payment processors, event organisers, or rights holders.

7. Buyer obligations

By placing an Order, the Buyer confirms that:

   1. the Buyer understands that TicketKosta is a secondary marketplace;
   2. the Buyer understands that Ticket prices may be above or below Face Value;
   3. the Buyer has reviewed the Event, date, venue, category, quantity, delivery method, price, fees, and any available restrictions before ordering;
   4. the Buyer is responsible for providing accurate contact, delivery, billing, and attendee information;
   5. the Buyer will comply with all venue, organiser, security, age, identification, dress code, conduct, supporter section, health, travel, visa, app, transfer, and entry rules;
   6. the Buyer will follow all delivery, transfer, app download, collection, membership card, and return instructions provided by TicketKosta or the Seller;
   7. the Buyer will not resell, copy, duplicate, misuse, alter, or distribute Tickets in a way that violates these Terms or applicable law;
   8. the Buyer will not initiate unjustified chargebacks after receiving valid Tickets or after refusing to cooperate with reasonable verification or delivery steps.
   9. the Buyer is responsible for checking the final Event date, kick-off time, start time, venue, travel requirements, and entry conditions. Event details may change after an Order is placed.

8. Seller obligations

By listing, supplying, transferring, or selling Tickets through TicketKosta, the Seller confirms and warrants that:

   1. the Seller owns the Tickets or has a lawful, binding, and enforceable right to sell and transfer the Tickets;
   2. the Tickets are genuine, valid, transferable, and will provide the Buyer with access to the Event, subject to ordinary venue rules and Buyer compliance;
   3. the Tickets are not stolen, cancelled, duplicated, void, fraudulently obtained, restricted in a way not disclosed, or subject to a chargeback or payment dispute;
   4. the Seller is not using bots, automated purchasing tools, unlawful harvesting methods, or other prohibited methods to obtain Tickets;
   5. the Seller will disclose all material Ticket information known to the Seller, including section, row, seat, standing area, category, Face Value where available,  age restrictions, supporter restrictions, ID requirements, app requirements, transfer restrictions, resale restrictions, collection requirements, view restrictions wheelchair or accessibility limitations, and any other condition that may affect use of the Ticket;
   6. the Seller will disclose whether the Seller is acting as a professional trader, business seller, broker, private individual, or consumer seller where this information is legally required or requested by TicketKosta;
   7. the Seller will provide TicketKosta with all information reasonably required for Know Your Business Customer, anti-fraud, tax, payment, sanctions, DSA, consumer protection, and platform compliance checks;
   8. where the Seller already owns Tickets that are not yet deliverable, for example not yet released by the primary issuer, the Seller will give an accurate in-hand or delivery-readiness date, keep it updated, and ensure it is no later than the delivery deadline for the Listing, it being understood that Tickets the Seller does not yet own may not be listed and that the Seller carries the risk of late or failed delivery unless the delay is caused by the Buyer;
   9. the Seller will cooperate with TicketKosta in case of Buyer complaints, entry problems, organiser changes, legal notices, rights holder complaints, payment disputes, or suspected invalidity;
   10. the Seller will indemnify TicketKosta and the Buyer for losses, refunds, chargebacks, penalties, replacement costs, claims, legal costs, and other damages arising from the Seller’s breach of these Terms. The Seller's indemnity also covers claims arising from Tickets the Seller had no right to sell, from the Seller's breach of the Event's or ticket issuer's own terms, and from infringement of third-party rights, including claims brought by partner sales channels and by regulatory or enforcement authorities, and it survives termination.

TicketKosta may require Sellers to provide proof of purchase, proof of ticket ownership, transfer screenshots, ID verification, company registration documents, bank account details, payment account details, tax details, and other information before a Listing is published, before funds are released, or after a dispute arises.

TicketKosta may remove any Listing, suspend any Seller, hold Seller funds, cancel a transaction, or report unlawful conduct where TicketKosta reasonably believes that the Seller has breached these Terms, applicable law, event rules, intellectual property rights, consumer protection rules, or platform safety requirements.

For a completed and undisputed sale, TicketKosta will pay the Seller the amount due, less applicable fees and any deductions permitted under these Terms, using the method and within the timeframe communicated to the Seller. Payment does not become due before TicketKosta has received the corresponding proceeds, and a Seller account or balance is not a deposit or savings facility. Where a sale is subject to a complaint, chargeback, suspected fraud, an invalid or undelivered Ticket, or another suspected breach, TicketKosta may withhold or delay the amount for that sale while it is investigated; and if TicketKosta has already paid the Seller for a sale that is later cancelled, reversed, or affected by cancellation of the Event, the Seller must reimburse the amount paid, and TicketKosta may recover it by set-off against any amounts due to the Seller. A payment or accounting statement is treated as final ninety (90) days after it is made, unless the Seller objects in writing within that period.

A Listing may be offered for sale on TicketKosta and on TicketKosta's partner sales channels, and the price shown to a Buyer on any channel may include TicketKosta's margin. The Seller's payout is based on the price the Seller sets, not on the price displayed on a partner channel, and TicketKosta decides on which channels a Listing is offered.

9. Listing rules

Sellers must ensure that all Listings are accurate, lawful, clear, and not misleading.

Listings must not:

   1. claim or imply that TicketKosta, the Seller, or the Listing is official, authorised, sponsored, endorsed, allocated, guaranteed by the organiser, or connected to the rights holder unless this is true and can be proven;
   2. use official logos, protected marks, trophies, emblems, copyrighted images, federation marks, Olympic marks, tournament wordmarks, club marks, venue marks, or other intellectual property except where lawful and necessary for nominative identification;
   3. advertise speculative Tickets that the Seller does not own or does not have a binding right to supply;
   4. hide restrictions that may affect the Buyer’s ability to use the Ticket;
   5. omit the Face Value shown on the Ticket where known, or any other material information likely to affect the Buyer's decision to buy, use of the Ticket, or entry to the Event;
   6. misrepresent the Ticket category, location, quantity, delivery method, validity, Face Value, or transferability;
   7. breach ticket resale laws, organiser terms, venue rules, sanctions rules, anti-touting rules, anti-scalping rules, or consumer protection laws in any applicable jurisdiction;
   8. list Tickets for Events, countries, venues, tournaments, or categories that TicketKosta has restricted or prohibited.

TicketKosta may classify certain Events as restricted or high risk. TicketKosta may refuse or remove Listings for such Events, apply noindex or restricted visibility, require additional seller proof, remove protected imagery, use neutral naming, or disable sales entirely.

10. Event information and category descriptions

TicketKosta may use its own category names to simplify the buying process. TicketKosta category names may differ from the official venue, club, federation, promoter, or organiser category names.

Unless exact seat details are clearly displayed before purchase, Buyers acknowledge that exact block, row, and seat numbers may not be known or available at the time of ordering. TicketKosta will use reasonable efforts to ensure that Tickets correspond to the category purchased or to a comparable or better category.

Maps, seat plans, category descriptions, and venue information are provided for guidance only. They may not reflect the final venue configuration, organiser allocations, broadcast requirements, security restrictions, or changes made after the Order.

Some Tickets may be for standing areas. Some Tickets may have a restricted or side view. Some Tickets may require entry through a specific gate, app, account, supporter section, membership card, or collection process. Any known material restrictions should be displayed where available and must be followed by the Buyer.

11. Home and away supporter sections

For sporting events, ticket categories may be intended for home supporters, away supporters, neutral areas, hospitality areas, family areas, or other sections.

Unless a category is expressly described as “away section” or similar, Tickets may be intended for home or neutral supporters. Buyers must not wear colours, behave, chant, or otherwise act in a way that violates venue or organiser rules for the section in which they are seated.

TicketKosta is not responsible for refusal of entry, removal from the venue, or other issues caused by the Buyer’s conduct, clothing, supporter affiliation, failure to follow rules, intoxication, abusive behaviour, security decisions, or breach of venue policies.

12. Order process and contract formation

An Order is submitted when the Buyer completes the checkout process and payment authorisation is received or another approved payment method is confirmed.

An automated email or website confirmation may acknowledge receipt of an Order, but it does not necessarily mean that the Order has been finally accepted or that a binding Ticket supply obligation has been confirmed.

An Order is accepted only when TicketKosta sends an order confirmation or otherwise confirms that the Order has been approved and is being processed.

TicketKosta may reject, cancel, or request further information for any Order before acceptance if:

   1. the Tickets are no longer available;
   2. the price or Listing information contained an obvious error;
   3. payment authorisation fails or is reversed;
   4. fraud, identity, sanctions, chargeback, or security checks are not passed;
   5. the Buyer fails to provide required information;
   6. the Seller fails verification or cannot supply the Tickets;
   7. the Event is restricted, cancelled, prohibited, or subject to a legal notice;
   8. fulfilling the Order would create legal, regulatory, payment, safety, or operational risk.

If an Order is rejected before acceptance, TicketKosta will arrange cancellation of the payment authorisation or refund any amount actually received, subject to payment processor timings.

13. Prices, fees, taxes, and currency

Ticket prices are resale marketplace prices. They may be above or below Face Value.

The total amount payable will be shown at checkout before the Buyer confirms the Order. The total may include Ticket price, booking fee, service fee, delivery fee, payment fee, tax, VAT, currency conversion, or other charges where applicable.

TicketKosta should display mandatory fees clearly before the Buyer completes checkout. If multiple delivery options are available, delivery costs may depend on the option selected.

Prices and availability may change at any time before an Order is accepted. Items placed in a cart are not reserved unless and until the Order is accepted.

Currency conversion rates may vary. Where the Website displays prices in a currency different from the final charging currency, the final charged amount will be shown at checkout or on the payment page. The Buyer’s bank, card issuer, or payment provider may apply additional currency conversion fees or charges that are outside TicketKosta’s control.

Buyers and Sellers are responsible for any taxes, duties, levies, reporting obligations, or other charges applicable to them under relevant law, except where TicketKosta is legally required to collect, report, or remit such amounts.

14. Payment and fraud prevention

TicketKosta may accept payment methods shown at checkout. Available payment methods may vary by country, currency, order value, risk assessment, and payment provider availability.

TicketKosta may use fraud prevention, payment verification, identity verification, address verification, 3D Secure, sanctions screening, chargeback screening, manual review, and other security measures.

TicketKosta may request additional information from the Buyer or Seller, including proof of identity, proof of address, cardholder confirmation, payment verification, attendee information, or other information reasonably required to process the Order, prevent fraud, comply with law, or protect the marketplace.

If the Buyer refuses or fails to provide required information within a reasonable time, TicketKosta may cancel the Order and apply the refund rules set out in these Terms.

The Buyer must not make false chargeback claims, reverse payment after receiving valid Tickets, or misuse buyer protection schemes. TicketKosta may contest chargebacks and provide evidence to payment providers.

15. Delivery and transfer of Tickets

Delivery methods may include email, mobile transfer, app transfer, PDF e-ticket, paper delivery, courier, hotel delivery, personal handover, pick-up point, stadium collection, account transfer, membership card, or another method specified by TicketKosta.

Delivery timing depends on the Event, organiser release schedule, Seller delivery method, ticket format, security rules, and transfer restrictions. For many events, Tickets may be delivered close to the Event date, including one to three days before the Event or, in limited cases, on the day of the Event.

The Buyer must provide accurate delivery details and must remain available through the email address and telephone number provided during checkout.

Once Tickets are sent to the email address, mobile number, app account, courier address, hotel, authorised recipient, pick-up point, or collection method provided by the Buyer, the Tickets will be considered delivered, unless the Buyer proves that the delivery failed due to TicketKosta’s or Seller’s fault.

If delivery requires app installation, account creation, acceptance of transfer, ID upload, venue account login, phone number verification, or similar steps, the Buyer must complete those steps promptly.

If a Buyer fails to collect Tickets, refuses delivery, provides incorrect details, ignores instructions, misses a courier, fails to attend a pick-up point, fails to download a required app, or fails to cooperate with delivery, the Order may be treated as delivered and no refund may be due, subject to applicable law.

16. Membership cards and loaned access cards

For some events, access may be provided through a membership card, season card, access card, or similar reusable item.

Where this applies, the Buyer must follow all instructions regarding use, safekeeping, return, and timing. The Buyer must not copy, damage, lose, misuse, sell, transfer, or keep any membership card or access card.

Failure to return a membership card or access card as instructed may result in a charge, penalty, replacement fee, administrative fee, or claim for any loss caused. The amount may vary depending on the card, club, supplier, and replacement cost.

17. Event changes, postponements and rescheduling

Event dates, times, venues, line-ups, participants, performers, teams, stages, fixtures, competitions, and formats may change after an Order is placed. These changes are controlled by the organiser, venue, promoter, federation, league, club, authorities, broadcasters, or other third parties and are outside TicketKosta’s control.

If an Event is postponed or rescheduled, Tickets will usually remain valid for the new date or time. In that case, the Order remains valid and no refund is due solely because of the postponement or rescheduling, unless applicable law requires otherwise or the TicketKosta Guarantee expressly provides otherwise.

Buyers are responsible for monitoring official Event information and making appropriate travel, accommodation, visa and personal arrangements.

TicketKosta is not responsible for travel costs, accommodation costs, lost wages, flight costs, visa costs, transport costs, meals, exchange rate losses, or other indirect costs caused by Event changes, postponements, rescheduling, relocation, cancellation, or admission decisions.

18. Event cancellation

If an Event is cancelled and not rescheduled, TicketKosta will review the Order and applicable refund options.

The Buyer’s remedy may depend on the Seller’s obligations, organiser refund policy, original ticket refund availability, payment status, the TicketKosta Guarantee, and applicable law.

Where TicketKosta receives a refund from the Seller, organiser, supplier, or relevant party for cancelled Tickets, TicketKosta will pass the applicable refund to the Buyer after deduction of any non-refundable fees where legally permitted and clearly disclosed.

Where TicketKosta provides an additional marketplace guarantee, the terms of that guarantee will apply.

Refunds may take time to process depending on the payment method, payment provider, acquiring bank, card issuer, and banking network.

19. No voluntary cancellation by Buyer

Tickets for live events are time-sensitive and relate to leisure activities scheduled for a specific date or period. Unless required by applicable law or expressly agreed by TicketKosta in writing, Orders are final once accepted and cannot be cancelled, exchanged, or refunded at the Buyer’s request.

This does not affect any mandatory legal rights the Buyer may have under applicable consumer protection law.

20. TicketKosta Guarantee

TicketKosta may provide a limited marketplace guarantee to Buyers.

Subject to these Terms, the TicketKosta Guarantee means that if a Buyer does not receive valid Tickets in time for the Event due to reasons attributable to the Seller or TicketKosta, TicketKosta may, at its discretion and depending on availability:

   1. provide replacement Tickets in the same or a comparable category;
   2. provide replacement Tickets in a better category without additional charge;
   3. provide a partial refund where the delivered Tickets are materially lower than the category ordered;
   4. provide a refund of up to 100% of the Ticket price paid for the affected Ticket;
   5. take another reasonable corrective action.

The TicketKosta Guarantee does not apply where the problem is caused by:

   1. the Buyer’s failure to provide accurate information;
   2. the Buyer’s failure to follow delivery, transfer, app, collection, or venue instructions;
   3. refusal of entry caused by the Buyer’s behaviour, intoxication, security issue, dress code, supporter affiliation, late arrival, lack of ID, lack of visa, lack of travel documents, or breach of venue rules;
   4. Event postponement or rescheduling where the Ticket remains valid;
   5. travel restrictions, personal circumstances, illness, transport disruption, or inability to attend;
   6. loss, theft, damage, copying, or misuse of Tickets after delivery;
   7. actions of the organiser, venue, authorities, police, security, federation, club, team, performer, or promoter outside TicketKosta’s control, except where applicable law requires otherwise.

To claim under the TicketKosta Guarantee, the Buyer must contact TicketKosta as soon as possible and provide evidence of the issue. For entry problems, the Buyer must contact TicketKosta immediately while at the venue or as soon as reasonably possible, and must provide proof such as venue refusal documentation, screenshots, photos, videos, app error messages, or other supporting evidence.

TicketKosta may reject claims submitted late if the delay prevents TicketKosta from investigating or resolving the issue.

21. Adjacent seats, substitutes and category differences

Where a Listing states that seats are together, TicketKosta will use reasonable efforts to deliver adjacent seats. Unless expressly stated otherwise, “seats together” usually means seats next to each other in pairs. For larger groups, seats may be split into pairs or smaller groups unless the Listing or order confirmation states otherwise.

If exact Tickets are not available, TicketKosta may provide substitute Tickets in the same or a comparable category. If replacement Tickets are in a materially lower category, the Buyer may be entitled to a partial refund reflecting the difference in category. If replacement Tickets are in a better category, the Buyer will not be charged extra unless agreed in advance.

TicketKosta’s own category descriptions may differ from official venue categories. Any assessment of comparability will be based on the TicketKosta category purchased, the venue layout, and the overall location of the replacement Tickets.

22. Refusal of admission and venue rules

Admission to an Event is controlled by the organiser, venue, promoter, club, federation, security staff, police, public authorities, and other third parties. TicketKosta does not control admission decisions.

The Buyer must comply with all applicable rules, including rules relating to ID, age, nationality, supporter sections, dress code, alcohol, prohibited items, bag size, arrival time, entry gate, app transfer, ticket personalisation, health requirements, security checks, and conduct.

TicketKosta is not responsible for refusal of admission or removal from a venue unless the refusal is caused by an invalid Ticket or another issue covered by the TicketKosta Guarantee.

If Tickets are nominative, personalised, or displayed with a name that differs from the Buyer or attendee, the Buyer acknowledges that admission may be subject to organiser or venue rules. TicketKosta and Sellers must disclose known nominative or ID restrictions where available.

23. Intellectual property and no affiliation

All trademarks, service marks, trade names, logos, team names, club names, performer names, event names, tournament names, venue names, images, emblems, trophies, and other intellectual property displayed or referenced on the Website belong to their respective owners.

TicketKosta uses third-party names only where necessary to identify Events, teams, performers, venues, or categories for marketplace purposes. Such use does not imply affiliation, endorsement, sponsorship, authorisation, allocation, or official partnership.

TicketKosta does not authorise Sellers or users to upload, display, or use protected logos, images, emblems, trophies, official artwork, copyrighted material, or trademarks in an infringing or misleading way.

Rights holders may contact legal@ticketkosta.com with specific URLs, screenshots, trademark details, copyright details, and an explanation of the concern. TicketKosta will review specific notices in good faith and may remove, disable, restrict, or modify content where appropriate.

24. Restricted events and local resale laws

Ticket resale laws and organiser restrictions vary by country, Event, ticket type, venue, tournament, and category. Some Events may prohibit resale, restrict resale above Face Value, require use of an official resale platform, require ticket personalisation, prohibit transfer, impose local licensing rules, or expose Sellers to penalties.

TicketKosta may restrict, delist, noindex, suspend, or remove Events, Listings, images, names, or Tickets where TicketKosta reasonably believes that continued listing may breach applicable law, organiser rules, rights holder rights, payment provider rules, or platform risk policies.

Sellers are responsible for ensuring that they are legally permitted to list and transfer their Tickets. Buyers are responsible for understanding that organiser or venue terms may affect entry.

TicketKosta may cooperate with rights holders, regulators, payment processors, law enforcement, or competent authorities where legally required or where necessary to protect users and the platform.

25. User content and platform moderation

Users may provide content to TicketKosta, including Listings, descriptions, messages, reviews, documents, images, and support communications.

Users must not submit content that is unlawful, fraudulent, misleading, defamatory, abusive, discriminatory, infringing, spam, malware, harmful, privacy-invasive, or in breach of these Terms.

TicketKosta may use automated tools, manual review, user reports, rights holder notices, payment risk signals, fraud checks, and moderation processes to detect and address problematic content or conduct.

TicketKosta may remove content, restrict visibility, suspend users, cancel transactions, hold funds, request further information, or take other proportionate measures where content or conduct appears to breach these Terms or applicable law.

Where required by applicable law, TicketKosta will provide information about moderation decisions and available appeal options.

26. Notice and takedown procedure

If you believe that content on the Website is illegal, infringes your rights, misleads consumers, breaches event rules, or otherwise violates these Terms, please send a notice to legal@ticketkosta.com.

A notice should include:

   1. your full name and organisation;
   2. your contact email address;
   3. your authority to act, if acting for a rights holder or organiser;
   4. the exact URL or location of the content;
   5. screenshots where helpful;
   6. a clear explanation of the alleged issue;
   7. supporting documents, such as trademark certificates, copyright ownership evidence, court orders, organiser rules, or legal references;
   8. a statement that the information provided is accurate to the best of your knowledge.

TicketKosta will review notices in good faith. TicketKosta may remove or disable content without admitting liability, wrongdoing, infringement, or breach.

If a notice is unclear, overly broad, or does not identify specific content, TicketKosta may request further information before taking action.

27. Misuse policy

TicketKosta may take action against misuse of the Website, including:

   1. fraudulent listings;
   2. speculative listings without a right to supply;
   3. fake Tickets;
   4. duplicate Tickets;
   5. chargeback abuse;
   6. false complaints;
   7. use of bots or scraping tools;
   8. uploading infringing logos or images;
   9. misleading official affiliation claims;
   10. harassment or abusive customer support communications;
   11. attempts to bypass payment systems;
   12. attempts to move transactions off-platform;
   13. multiple accounts used to avoid restrictions;
   14. refusal to cooperate with compliance checks;
   15. conduct that may harm Buyers, Sellers, TicketKosta, rights holders, payment processors, or other users.

Depending on the severity, TicketKosta may warn the user, remove content, suspend an account, permanently terminate an account, cancel transactions, hold funds, report conduct to authorities, or take legal action.

28. Privacy and personal data

TicketKosta processes personal data in accordance with its Privacy Policy and Cookie Policy.

TicketKosta may process personal data for account creation, order processing, payment handling, fraud prevention, customer support, ticket delivery, app transfer, legal compliance, seller verification, buyer verification, rights holder notices, dispute handling, chargebacks, tax compliance, security, analytics, and marketing where permitted.

TicketKosta may share necessary personal data with Sellers, Buyers, payment processors, delivery partners, fraud prevention providers, identity verification providers, IT providers, professional advisers, authorities, and event-related parties where required to complete an Order, comply with law, prevent fraud, resolve disputes, or enforce these Terms.

Users must not misuse personal data received through the Website. Sellers must use Buyer data only for fulfilment of the relevant Order and must not use it for marketing or unrelated purposes.

29. Communications

TicketKosta may contact users by email, telephone, SMS, WhatsApp, app notification, account message, or other communication method provided by the user where necessary for order processing, delivery, support, verification, fraud prevention, legal notices, or urgent Event updates.

Users must ensure that contact details remain accurate and must check their email, spam folder, phone, and messaging channels regularly before the Event.

30. Reviews and public statements

TicketKosta may invite Buyers to leave reviews. Users must ensure that reviews and public statements are truthful, fair, and based on genuine experience.

TicketKosta may request removal of reviews or content that is false, defamatory, abusive, fraudulent, privacy-invasive, or unrelated to a genuine transaction.

Nothing in these Terms prevents users from leaving honest reviews or exercising rights under applicable law.

31. Third-party websites and services

The Website may link to third-party websites, payment providers, delivery providers, social media platforms, maps, event information pages, venue pages, or app providers.

TicketKosta is not responsible for third-party websites or services. Use of third-party services may be subject to separate terms and privacy policies.

32. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights that cannot be excluded.

Subject to the above, TicketKosta is not liable for:

   1. Event cancellation, postponement, rescheduling, relocation, line-up changes, fixture changes, or performance changes caused by third parties;
   2. refusal of entry or removal caused by Buyer conduct, failure to follow rules, or venue security decisions;
   3. travel, accommodation, transport, visa, food, lost wages, or other indirect costs;
   4. loss caused by inaccurate information provided by the Buyer or Seller;
   5. loss caused by a Seller’s breach, except to the extent covered by the TicketKosta Guarantee or applicable law;
   6. website interruptions, technical failures, cyber incidents, payment outages, or delivery delays outside TicketKosta’s reasonable control;
   7. loss of profit, business interruption, loss of opportunity, reputational loss, or consequential damages.

Subject to applicable law and the TicketKosta Guarantee, TicketKosta’s total liability for an Order is limited to the amount paid by the Buyer for the affected Tickets.

33. Indemnity

Users agree to indemnify and hold TicketKosta harmless from claims, losses, damages, liabilities, refunds, chargebacks, penalties, fines, legal costs, and expenses arising from:

   1. breach of these Terms;
   2. fraud, misrepresentation, or unlawful conduct;
   3. invalid, stolen, cancelled, duplicated, or restricted Tickets supplied by a Seller;
   4. infringement of intellectual property rights;
   5. breach of privacy or data protection obligations;
   6. misuse of the Website;
   7. chargeback abuse;
   8. breach of event rules or local resale laws;
   9. any claim by a Buyer, Seller, organiser, rights holder, payment processor, authority, or third party caused by the user’s actions or omissions.

34. Suspension and termination

TicketKosta may suspend or terminate access to the Website, remove Listings, cancel Orders, hold funds, or restrict services if a user breaches these Terms, violates law, fails verification, creates risk, abuses the platform, or harms other users.

Where required by applicable law, TicketKosta will act proportionately and provide information about the reason for restriction and available appeal options.

Users may stop using the Website at any time. Account closure does not affect existing Orders, payment obligations, disputes, claims, delivery duties, refund duties, fraud investigations, or legal obligations.

35. Changes to these Terms

TicketKosta may update these Terms from time to time. Updated Terms will be posted on the Website with a revised “Last updated” date.

Material changes will not apply retroactively to Orders already accepted unless required by law or unless the change benefits the user.

Where required by applicable law, TicketKosta will provide reasonable notice of significant changes and allow users to close their account if they do not agree.

Continued use of the Website after updated Terms take effect means that you accept the updated Terms.

36. Force majeure

TicketKosta is not responsible for failure or delay caused by events outside its reasonable control, including acts of God, war, terrorism, civil unrest, strikes, pandemics, epidemics, government restrictions, border closures, transport failures, venue closures, cyberattacks, payment outages, courier failures, internet outages, power failures, or actions by organisers, venues, authorities, clubs, federations, performers, teams, or rights holders.

37. Governing law and jurisdiction

These Terms are governed by the laws of [GOVERNING LAW JURISDICTION], subject to any mandatory consumer protection rights that apply in the country where the Buyer resides.

If you are a consumer residing in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protections, you may have the right to rely on the mandatory laws and courts of your country of residence where those rights cannot legally be excluded.

TicketKosta may bring proceedings against a Seller, Buyer, or user in any jurisdiction where the user is located, where the breach occurred, where harm occurred, or where enforcement is necessary.

38. Complaints and dispute resolution

If you have a complaint, please contact TicketKosta first at support@ticketkosta.com and include your order number, Event, email address used for the Order, explanation of the issue, and supporting evidence.

TicketKosta will review complaints in good faith and seek to resolve them fairly and efficiently.

Where applicable, consumers may also have access to alternative dispute resolution bodies, consumer authorities, courts, or other mandatory redress mechanisms in their country of residence.

The European Online Dispute Resolution platform has been discontinued. TicketKosta should not include outdated links to the discontinued ODR platform.

39. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be limited or removed to the minimum extent necessary. The remaining parts will continue to apply.

40. No waiver

If TicketKosta does not enforce any part of these Terms immediately, this does not mean that TicketKosta has waived the right to enforce it later.

41. Assignment

TicketKosta may assign, transfer, subcontract, or delegate its rights and obligations under these Terms to another group company, service provider, purchaser, successor, or business partner, provided that this does not reduce mandatory consumer rights.

Users may not assign or transfer their rights or obligations under these Terms without TicketKosta’s prior written consent.

42. Entire agreement

These Terms, together with the Privacy Policy, Cookie Policy, order confirmation, checkout information, and any event-specific terms, form the entire agreement between the user and TicketKosta regarding use of the Website and the relevant Order.
